Terms of Service

These Terms of Service ("Terms") govern your use of the Questr mobile application ("App") operated by Questr ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 16 years old to use the App. By creating an account, you represent that you are at least 16 years old. We reserve the right to terminate accounts of users who misrepresent their age.

2. Account Creation and Responsibilities

2.1 Account Registration

You may register using an email address and password, Sign in with Apple, or Sign in with Google. You agree to provide accurate information and keep it current.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at nick@questr.tv if you suspect unauthorized use.

2.3 One Account Per Person

You may not create multiple accounts or accounts on behalf of others without their consent. Accounts used for abuse, spam, or harassment will be terminated.

2.4 Account Deletion

You may delete your account at any time through the App's settings screen. Upon deletion, your data is processed as described in our Privacy Policy. Deletion is irreversible.

3. User-Generated Content

3.1 Your Content

The App allows you to record and share short videos ("Content") within private groups and optionally on the community feed. You retain ownership of the Content you create.

3.2 License Grant

By submitting Content to the App, you grant Questr a non-exclusive, worldwide, royalty-free license to store, process, transcode, display, and distribute your Content to:

• Members of your private group
• Other users of the App (if you share to the community feed)
• Our third-party service providers (Bunny Stream, Supabase) as necessary to operate the App

This license terminates when you delete the Content or your account, subject to reasonable processing delays and any legal retention requirements.

3.3 Content Representations

By submitting Content, you represent that:

• You created the Content or have the right to share it
• The Content does not infringe any third party's intellectual property rights
• The Content complies with our Community Guidelines (Section 4)
• You have obtained consent from any identifiable individuals who appear in your Content (other than incidental appearances in public spaces)

3.4 Content Moderation

We reserve the right, but not the obligation, to review, moderate, remove, or restrict access to any Content at our sole discretion. We use automated moderation tools and human reviewers. We are not liable for failing to detect or remove prohibited Content.

4. Community Guidelines

The following are strictly prohibited. Violations may result in content removal, account suspension, or permanent termination.

4.1 Prohibited Content

• Nudity and sexual content: Explicit sexual content, nudity, or content that sexualizes any person
• Content involving minors: Any sexual or exploitative content involving minors; this will be reported to relevant authorities
• Violence and harm: Graphic depictions of real violence, content that glorifies self-harm or suicide, or content that encourages dangerous illegal activities
• Hate speech: Content that attacks or dehumanizes individuals or groups based on race, ethnicity, religion, sex, gender identity, sexual orientation, disability, or national origin
• Harassment and bullying: Targeted harassment, threats, or doxxing of any individual
• Illegal activity: Content that depicts, promotes, or solicits illegal activity
• Spam and manipulation: Coordinated inauthentic behavior, fake accounts, or repeated unsolicited contact
• Intellectual property infringement: Content that infringes copyrights, trademarks, or other intellectual property rights

4.2 Challenge Content

Challenges issued through the App are designed to be entertaining and safe. You are responsible for completing challenges in a lawful and safe manner. You must not:

• Endanger yourself or others while completing a challenge
• Complete challenges in ways that involve illegal activity
• Film challenges in locations where recording is prohibited

The following challenge activities are explicitly prohibited:

• Ingesting harmful, toxic, or non-food substances
• Activities at dangerous heights or involving intentional falling
• Activities near or involving traffic, railways, or moving vehicles
• Activities involving fire, explosives, or pyrotechnics
• Water submersion, breath-holding, or choking activities
• Use of weapons, knives, or power tools in an unsafe manner
• Physical confrontation, fighting, or assault
• Deliberate property damage or vandalism
• Trespassing or illegal entry into restricted areas
• Activities requiring medical or professional training
• Any activity involving drugs or excessive alcohol consumption
• Any activity that could cause injury to children or animals

4.3 Reporting

You may report Content or accounts that violate these guidelines using the in-app reporting feature. We aim to review reports within 24 hours and take enforcement action as appropriate. We will not share the identity of reporters with the subject of a report.

4.4 Copyright and Takedown Procedures

Questr respects the intellectual property rights of others. If you believe that Content on the App infringes your copyright or other intellectual property rights, please follow the applicable procedure below.

DMCA Takedown Notices (United States)

If you are a copyright owner or authorised agent in the United States, you may submit a takedown notice under the Digital Millennium Copyright Act (17 U.S.C. Section 512). Your notice must include the following:

1. A physical or electronic signature of the copyright owner or a person authorised to act on their behalf
2. Identification of the copyrighted work claimed to have been infringed
3. Identification of the infringing Content and information reasonably sufficient to locate it within the App
4. Your contact information, including address, telephone number, and email address
5. A statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law
6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorised to act on the copyright owner's behalf

Counter-Notice: If you believe your Content was removed in error, you may submit a counter-notice containing: (a) your physical or electronic signature; (b) identification of the removed Content and its prior location; (c) a statement under penalty of perjury that you believe the Content was removed by mistake or misidentification; and (d) your name, address, and telephone number, along with a statement that you consent to the jurisdiction of the federal court in your district and will accept service of process from the person who submitted the original notice. We will forward the counter-notice to the original complainant and restore the Content within 10-14 business days unless the complainant files a court action.

UK Takedown Requests

If you are based in the United Kingdom, you may submit a takedown request in accordance with the Electronic Commerce (EC Directive) Regulations 2002. Please include the same information described above and send your request to nick@questr.tv.

Repeat Infringer Policy

Questr will terminate the accounts of users who are determined to be repeat infringers of intellectual property rights. Repeat infringement includes receiving multiple valid takedown notices or engaging in a pattern of uploading infringing Content.

5. Intellectual Property

5.1 Our Property

The App, its design, logo, and all content we create (excluding user-generated content) are owned by Questr or our licensors and are protected by applicable intellectual property law. You may not copy, modify, distribute, or create derivative works from our property without our express written permission.

5.2 Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us a perpetual, royalty-free right to use that feedback without any obligation to you.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it at https://questr.tv/privacy.

7. Push Notifications and Communications

By creating an account, you consent to receive push notifications related to daily challenges, group activity, and weekly results. You may opt out of push notifications at any time through your device settings. We may also send you service-related emails (for example, about account security or policy changes); these are not marketing communications and cannot be opted out of while your account is active.

8. Third-Party Services

The App integrates with third-party services including Supabase, Bunny Stream, PostHog, Expo, Apple, and Google. Your use of features that interact with those services is also subject to their respective terms and policies. We are not responsible for the practices of third-party services.

9. Prohibited Uses

In addition to the Community Guidelines, you agree not to:

• Reverse engineer, decompile, or disassemble any part of the App
• Use automated scripts, bots, or scraping tools to interact with the App
• Interfere with or disrupt the App's infrastructure or other users' experience
• Attempt to gain unauthorized access to any systems, accounts, or data
• Use the App for any commercial purpose without our express written consent
• Circumvent any access controls, geo-restrictions, or content moderation measures

10. Termination

10.1 By You

You may stop using the App and delete your account at any time.

10.2 By Us

We may suspend or permanently terminate your account at any time for any reason, including but not limited to violations of these Terms. We will make reasonable efforts to notify you, but are not obligated to do so where the violation is severe (for example, content involving minors).

10.3 Effect of Termination

Upon termination, your license to use the App ends immediately. Sections that by their nature should survive termination (including Sections 3.2, 5, 11, 12, and 13) will survive.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be available at all times, free of errors, or that defects will be corrected. Challenge content is provided for entertainment purposes and we make no warranties about its suitability for any individual.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUESTR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100 USD.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of England and Wales. Before commencing court proceedings, both parties agree to attempt to resolve the dispute through good-faith negotiation for a period of at least 30 days.

Nothing in this section limits your right to bring proceedings in any court of competent jurisdiction to protect your legal rights under applicable consumer protection law.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the App or by email at least 14 days before the change takes effect. Your continued use of the App after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App and delete your account.

15. Subscriptions and In-App Purchases

Questr offers an optional auto-renewing subscription, Questr Plus, and one-off purchases of in-app coins.

Questr Plus is billed at £3.99 / month or £24.99 / year (prices may vary by territory and are shown in the App before purchase). New subscribers may be offered a 7-day free trial; if you do not cancel before the trial ends, the subscription begins and you are charged the price shown.

Questr Plus automatically renews at the end of each billing period unless you cancel at least 24 hours before the period ends. Your iTunes/App Store account is charged for renewal within 24 hours of the end of the current period. You can manage or cancel your subscription at any time in your device's Settings → [your name] → Subscriptions, or via the "Manage subscription" link in the App. Cancelling stops future renewals; the current paid period is not refunded.

Questr Plus unlocks convenience features (more daily quest pulls and slots, double quest coins, premium cosmetics, a monthly streak freeze, and a larger weekly pixel allowance). It does not confer any competitive advantage that can be won by other users.

Coins purchased in the App are a one-off consumable used for cosmetic and in-app items. Coins have no real-world monetary value, are non-transferable, and do not expire.

All purchases are processed by Apple under Apple's standard terms; refunds are handled by Apple in accordance with their policies.
